托马斯·M·库里(Thomas M.Cooley)(1824—1898),美国密歇根大学法学院教授,1871年至1883年任该法学院院长,1865年至1885年任密歇根州最高法院法官,1887年任美国州际商业委员会主席。主要著作有:《美国宪法的基本原则》(The General Principles of Constitutional Law in the United States of America,1880)、《对美国各州立法权的宪法性限制》(A Treatise on the Constitutional Limitations Which Rest upon the Legislative Power of the States of the American union,1868)、《侵权法》(A Treatise on the Law of Torts,1878)。①本文为库里在密歇根大学研究生班的演讲速记稿,原载《密歇根法学杂志》(Michigan Law Journal)1893年第2期,第109~120页。本文是美国宪法学说史上最早提出并论证宪法修改权内在界限的学术论文之一。
